Watersports of Palm Beach

In order to participate in the recreational activities provided by Watersports of Palm Beach, the renter must sign a rental contract and release of liability, waiver of claims, assumption of risks, and indemnity agreement. A pre-authorized credit card deposit of $250.00 per rental unit is required as a security damage deposit. Additionally, a valid credit card and 50% of your rental total are required on the date of booking. We accept Cash, Visa, Mastercard, and Amex. Renters are responsible for any physical damage to equipment, billed at $100 per inch.

For and in consideration of electing and being allowed to participate in certain recreational activities including Watersports of Palm Beach, the above-named guest and guest’s parent or guardian (if guest is a minor) hereby:

i) Acknowledges the risks associated with participating in the activities.

ii) Expressly and forever waives and releases any and all claims, proceedings, or actions for personal injury, death, or any loss or damage whatsoever (the “damages”) that Guest may suffer arising out of or in connection with Guest’s participation in the activities.

iii) Agrees to hold harmless Watersports of Palm Beach and each of their affiliates, parents, subsidiaries, shareholders, officers and directors, agents, employees, predecessors, and the heirs, successors, and assigns of each of them from any and all liability for damages to Guest or Guest’s heirs successors arising out of Guest’s participating in any activities.

iv) Accepts financial responsibility for the loss of or damage to any equipment used by guest.

Guest further acknowledges that the activities are provided by Watersports of Palm Beach or its agents and that any controversy arising in connection with this Waiver and Release or the participation by Guest in the Activities shall be governed by (Country) law and shall be adjudicated in the appropriate forum located in The Country.

**Notice:**

By executing this WAIVER AND RELEASE, Guest agrees to abide by all of the rules relating to the activities (including, without limitations, those on the reverse side of this WAIVER AND RELEASE), and Guest acknowledges that Guest may be relinquishing valuable legal rights. Execution of this form shall be conclusive evidence that Guest has read and understands this form including the WAIVER AND RELEASE, AND Watersports of Palm Beach RENTAL AGREEMENT) in its entirety and intends to be bound by its terms. 

Rental Policy and Requirements

Thank you for choosing Watersports of Palm Beaches for your water adventure! Before you embark on your thrilling experience, please review the following policies and requirements:

1. **Identification and Credit Card:**

   – All renters must present a valid government-issued photo ID that includes date of birth (ages 18 and older). No photocopies or photos will be accepted.

   – Renters are required to bring 1 credit card that matches the renter’s ID per reservation.

2. **Boater Safety Test:**

   – Renters born in 1988 or after must complete a Boater Safety Test or present a Florida Boater Safety License.

3. **Age Requirement:**

   – Renters must be at least 18 years old to participate.

4. **Arrival Time:**

   – Renters must be present at the pick-up location 20 minutes before their reservation time.

5. **Occupancy and Weight Limit:**

   – Two guests are allowed per JetCar and cannot exceed a total combined weight of 420 lbs.

6. **Liability Waiver:**

   – All participants must complete and sign the Liability Waiver before starting the ride.

   – Renters cannot participate if they possess or are under the influence of drugs or alcohol, are pregnant, have any existing medical conditions that put them or others at risk, or are unable to follow any spoken instructions.

7. **Refunds:**

   – No refunds will be issued if you don’t show up or cancel your reservation.

   – If you cannot make it to your reservation, you must notify us 24 hours ahead to reschedule. No refunds will be issued.

   – Due to weather conditions, we may reschedule the day of your reservation.

8. **Damage Deposit:**

   – Every rental undergoes an inspection prior and after your rental, and the renter must be present at the time of inspection.

   – Renters are responsible for any and all damages to rental equipment, persons, or property during the rental.

   – A rental contract, release of liability, waiver of claims, assumption of risk, and indemnity agreement must be signed by renters, and a pre-authorization credit card deposit of $500 per rental unit is required as a damage deposit.

   – The cardholder must be present to sign the damage deposit and rental agreement.

   – Renters are responsible for any damages during the rental duration, with physical damage to equipment billed at $100 per inch.

Failure to comply with the above requirements may result in your reservation being canceled, with no refund issued for your reservation payment.
